WINDHOEK, 21 JUL – A prominent Windhoek-based defence lawyer and two other people arrested in March in connection with the alleged fraudulent sale of a house that did not belong to them for N.dollars 2.5 million and pocketing the proceeds, on Friday denied committing the offence.
Local defence lawyer Titus Mbaeva is on trial in the Windhoek Magistrate’s Court for allegedly having conspired with activist August Maletzky and Simon Edward Afrikaner in defrauding an elderly Angolan couple by forging power of attorney documentation.
The forged documents allegedly gave the three accused the legal rights to dispose of the couple’s home in Windhoek West.
The trio each denied the allegations when they entered not guilty pleas to the fraud charges against them before Windhoek Magistrate Samunzala Linus Samunzala on Friday.
They entered their preliminary not guilty pleas to the charges in the presence of their defence lawyers Slysken Makando and Orben Sibeya and as per the provisions of Section 119 of the Criminal Procedures Act of 1977.
The matter was, thereafter, postponed to 31 August 2018 to allow the Office of the Prosecutor-General to take a decision on how to proceed with the case.
Mbaeva and Maletzky are free on bail of N.dollars 40 000 and N.dollars 100 000, respectively. Afrikaner is also free on bail of N.dollars 20 000.
It is alleged that the three men fraudulently sold the house worth N.dollars 2.5 million without the couple’s knowledge or permission to do so.
It is further alleged that after selling the house, they failed to hand over the funds to the homeowners.
In addition, it is alleged that Maletzky was living in the aforesaid house on a lease agreement before it was illegally sold off.
The three men are each charged with fraud of allegedly and corruptly using a false document by an agent and conspiracy to commit an offence in respect of the illegal sale of the couple’s house.
They were arrested in March 2018 following an Anti-Corruption Commission (ACC) investigation into the alleged illegal sale of the house.
Public Prosecutor Tatelo Lusepani represented the State on Friday.
