WINDHOEK, 22 MAY – The Magistrate’s Court here has issued a warrant for the arrest of a local estate administrator who stands accused of embezzling money from an inheritance he was entrusted to administer on behalf of the beneficiaries.
Mervin Kozonguizi, 42, was scheduled to make a third appearance in the Windhoek Magistrate’s Court Monday morning, but did not show up at the court.
Court documents availed to Nampa on Tuesday showed that Senior Public Prosecutor Rowan van Wyk applied for the warrant of arrest to be issued with immediate effect following the accused’s absence before court and Windhoek Magistrate Liwena Walter Mikiti issued the warrant.
Kozonguizi is free on bail of N.dollars 100 000 and the court also ordered that the bail money be provisionally cancelled and forfeited to the State’s coffers.
The bail and bail money will only be finally cancelled and forfeited to the State coffers once the accused fails to appear before court on 04 June 2018 to give a reasonable explanation for his absence.
The execution date of the warrant of arrest is Monday, 21 May 2018, reads the court order.
The estate administrator was initially charged with a count of fraud involving N.dollars 797 359.
However, the aforesaid charge was at a later stage changed to N.dollars 7 097 359.
A summary of substantial facts contained in the indictment alleges that Kozonguizi had defrauded the Master of the High Court between 2016 and January 2017 by pretending that he was entitled to receive funds from the estate of the late Gustav Tjiuiju.
It is alleged that Kozonguizi received nearly N.dollars 7.1 million from the estate while he was not entitled to the money.
Furthermore, it is alleged that he had also defrauded the Master of the High Court on 05 December 2015 by pretending that he was entitled to N.dollars 2 million from the estate of the late Yolandi Dorothy Beukes.
Kozonguizi operates under the name Kozonguizi & Associates and was administering deceased estates registered at the Master of the High Court.
He was arrested on 15 January 2018 by investigators attached to the Anti-Corruption Commission.
Windhoek-based defence lawyer Orben Sibeya is representing the accused.
