WINDHOEK, 29 AUG – A resident of the DRC informal settlement in Swakopmund serving a 30-year prison term for killing his girlfriend during October 2012, is now fighting for a reduction of his sentence.
On 20 November 2015, High Court Judge Christie Liebenberg sent Fabianus Shekunyenge, 35, to jail for the murder of Rodnella Awises, 19, whom he beat to death with a stick and a palm tree branch on 28 October 2012.
Shekunyenge’s appeal application against the long custodial term was scheduled to kick-off before the same judge on Wednesday, but could not proceed because the Justice Ministry’s Directorate of Legal Aid has not yet instructed a defence lawyer to come and represent the appellant during the hearing of his appeal bid.
The case was, thereafter, postponed to 24 October 2018 to allow the Legal Aid Directorate enough time to appoint and instruct a State-funded defence lawyer for Shekunyenge.
In the appeal application, Shekunyenge wants the court to re-look into the totality of the evidence of the trial, the court’s judgment and asks for a reduction of the sentence because he feels the punishment was too heavy and long comparing to other sentences handed down in courts for similar or related criminal offences.
Titus Ipumbu, who defended Shekunyenge during trial, had asked the court to impose a prison term of no more than 15 years as a custodial sentence would be inevitable.
Prosecution representative, State Advocate Shakwa Nyambe had asked the court to impose a sentence of at least 35 years imprisonment.
Shekunyenge is serving his prison sentence at the Windhoek Central Correctional Facility. – NAMPA
