WINDHOEK, 21 AUG – Omukwaniilwa Immanuel Kauluma Elifas will not testify in court, the Ondonga Traditional Authority’s senior councillor for the Oniimwandi District, Naeman Amalwa said Monday.
Amalwa made these remarks during a question and answer session after President Hage Geingob met with representatives of Omukwaniilwa (king) Elifas at State House on Monday.
“For now, the king will not appear in court. Even if he was to be summoned, the traditional authority has applied for leave to appeal and we are waiting for a response from the Oshakati court,” Amalwa said.
Ondonga senior councillors Joseph Asino, Peter Kauluma, Vilho Kamanya and John Walenga, who were dismissed along with junior councillors, Kashona kaMalulu, Fillemon Nambili and Tonata Ngulu by Elifas in July last year, are challenging their dismissal in the High Court.
They last year received letters of dismissal on charges of misconduct, but have refuted the authenticity of these letters, arguing that they were not issued by Elifas and that the signature on the letters is not his.
They have demanded that the king be brought to court to testify, arguing the decision for them to be fired was not his.
The Oshakati Division of the High Court accepted the demand and Judge Maphios Cheda on 09 August granted the lawyers of the two parties 14 days to set a date for Elifas to appear in court to confirm whether he indeed fired the councillors.
The king’s delegation had a meeting with Geingob on invitation by the president, who wanted to know what can be done to resolve the matter at the palace.
“He advised us to deal with the dispute traditionally, within the community, instead of continuing with it in court,” Amalwa said.
He added that although the court matter is still ongoing, they are going to try and talk to the applicants again, just to try and solve the issue amicably.
“We are actually looking forward to working together and we are hoping that there will be an amicable solution after the discussions we have with the other group,” Amalwa said.
